End User License Agreement
1. Acceptance
By downloading, accessing, or using CourseNinja, you agree to this End User License Agreement. If you do not agree, do not use the app. If you use CourseNinja on behalf of a school, business, or organization, you represent that you have authority to accept these terms for that organization.
2. License
CourseNinja is licensed, not sold. Subject to this Agreement and Apple’s Usage Rules, we grant you a limited, non-transferable, non-exclusive license to install and use CourseNinja on Apple-branded devices that you own or control. You may not copy, modify, reverse engineer, sublicense, sell, or redistribute CourseNinja except as allowed by law.
3. Accounts and Eligibility
You are responsible for your account and for keeping your sign-in credentials secure. CourseNinja is not intended for children under 13 unless a parent, guardian, school, or authorized adult has provided any required consent and the app is configured for that use.
4. Learning Content and AI Features
CourseNinja may provide vocabulary, translations, pronunciations, images, tutorials, quizzes, and AI-generated course drafts. Content may be incomplete, inaccurate, inappropriate for your context, or unavailable in some languages. CourseNinja is a learning aid and does not guarantee fluency, academic results, or error-free translation.
5. Your Content
You keep ownership of courses, text, images, audio, feedback, and other content you create or upload, subject to rights held by others. You grant us a worldwide, non-exclusive license to host, store, process, reproduce, display, transmit, adapt, and use your content to operate, improve, protect, and provide CourseNinja. If you publish or share content, you also grant us the rights needed to make that content available to other users.
6. Content Responsibilities
You represent that you have the rights needed for content you upload, generate, publish, or share. You may not upload or publish unlawful, infringing, abusive, sexually explicit, hateful, deceptive, harmful, or privacy-invasive content. You may not use CourseNinja to harass others, collect personal information without permission, or create content that violates another person’s rights.
7. Third-Party and Generated Media
CourseNinja may use third-party providers for images, translation, speech, cloud services, authentication, AI generation, and app distribution. Some media may require attribution or be subject to separate provider terms. AI-generated images may be labeled as generated with AI and may include provenance metadata instead of photographer attribution. You are responsible for reviewing generated or selected assets before publishing a course.
8. Subscriptions, Gems, and Purchases
Some features may require a subscription, in-app purchase, paid course entitlement, or virtual currency such as gems. Prices, renewals, refunds, and purchase restoration are handled through Apple where required. Gems and digital entitlements have no cash value, are not banked funds, and may be limited by expiration, abuse controls, or account restrictions unless applicable law requires otherwise.
9. Moderation and Enforcement
We may review, reject, remove, restrict, or disable content or accounts when we believe this Agreement, law, platform rules, or community standards may be violated. We may also limit expensive or abuse-prone features, including AI generation, publishing, messaging, and downloads. We may provide notice and appeal options when practical.
10. Privacy
Our Privacy Policy explains how we collect, use, and share information. By using CourseNinja, you agree that we may process information as described in the Privacy Policy.
11. Feedback
If you send suggestions, ideas, or feedback, you grant us permission to use them without restriction or compensation. This does not transfer ownership of your private course content.
12. External Services
The app may link to or use external services. We are not responsible for third-party services, content, availability, or practices. You use external services at your own risk and must comply with their terms.
13. Termination
You may stop using CourseNinja at any time. We may suspend or terminate access if you violate this Agreement, create risk, fail to pay required charges, or if we discontinue the app or a feature.
14. No Warranty
CourseNinja is provided “as is” and “as available.” To the maximum extent permitted by law, we disclaim warranties of merchantability, fitness for a particular purpose, accuracy, quiet enjoyment, and non-infringement.
15. Limitation of Liability
To the maximum extent permitted by law, we will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, lost data, business interruption, substitute services, or content errors. Our total liability for claims relating to CourseNinja will not exceed the greater of the amount you paid for the app or service in the previous twelve months or fifty dollars (US $50), except where law requires otherwise.
16. Export and Legal Compliance
You may not use or export CourseNinja in violation of U.S. export laws or other applicable laws. You represent that you are not located in an embargoed country and are not on a restricted-party list.
17. Apple Terms
Apple is not responsible for CourseNinja or its content. Apple has no obligation to provide maintenance or support for CourseNinja. Apple and its subsidiaries are third-party beneficiaries of this Agreement and may enforce it against you as it relates to your licensed use of the app on Apple platforms.
18. Changes
We may update this Agreement. If changes are material, we will provide notice or require renewed acceptance. Continued use after an update means you accept the updated Agreement.
